Legal & AI Compliance

Our approach to responsible AI production, human oversight, commercial rights and international distribution.

Our approach

palaceIA is a human-led creative production initiative. We recognise the legal, ethical and commercial considerations involved in AI-assisted audiovisual work. We aim to identify relevant requirements early and collaborate with clients, agencies and their legal advisers on a project-by-project basis.

Human oversight & traceability

Creative direction, selection, editing and delivery remain subject to human oversight. For commissioned projects, we aim to maintain an appropriate production record identifying responsible team members, relevant AI providers and models (including versions where available), source materials, permissions, key approvals and the intended scope of use. Records may be shared subject to confidentiality and contractual arrangements.

Models, licences & intellectual property

Commercial availability of an AI tool does not by itself establish ownership, exclusivity or freedom from third-party claims. Proprietary and open-source models may both be considered, subject to their applicable terms, acceptable-use restrictions and the rights in inputs and outputs. We assess relevant commercial-use terms, training and confidentiality settings, third-party materials, trademarks, music and other protected elements before agreeing project-specific rights and deliverables.

People, likeness & voice

Use of identifiable people, performances, voice replicas and realistic synthetic representations may require consent, licences and additional review. We aim to agree the necessary authorisations and disclosure responsibilities before publication.

Distribution & client review

Each production brief should specify territories, media, duration, deliverables and intended usage. Any additional licences, clearances, technical marking or disclosures are assessed according to the project. The parties should document responsibilities, review stages and final approvals in the production agreement.

European Union

For projects involving the EU, we consider the EU AI Act (Regulation (EU) 2024/1689), including applicable Article 50 transparency obligations, alongside copyright, personality rights, consumer and advertising rules, and the GDPR where personal data is processed. Disclosure duties depend on the role of each operator and the nature of the content; not every AI-assisted advertisement requires the same notice. Local implementation and applicable exceptions must be assessed.

Latin America

Latin America is not a single legal jurisdiction. Projects are assessed country by country for copyright, image and voice rights, privacy, advertising, consumer protection and any applicable AI-specific measures. Local legal review may be needed before regional or multi-country distribution.

United States

For US distribution, we consider applicable federal and state rules concerning copyright, publicity and likeness rights, privacy, advertising claims, deceptive practices and synthetic media disclosures. Requirements can vary by state, platform, content type and use; additional legal review may be required.

Confidentiality & data

Client briefs, references and personal data should be handled in accordance with agreed confidentiality and data-protection terms. Use of third-party AI services, data retention, possible model-training uses and cross-border transfers should be reviewed before confidential or personal information is uploaded.

Legal notice

This page describes our intended production approach, not a certification, legal opinion, blanket warranty or commitment that every control has already been implemented. Each project requires its own contractual scope, rights assessment and, where appropriate, specialist legal advice. palaceIA is currently a commercial brand; the contracting legal entity and its details will be identified in each engagement.
